SAN FRANCISCO — The California Restaurant Association has announced it has filed suit against the city and county of San Francisco and the San Francisco Department of Public Health to overturn its menu labeling ordinance. Filed in federal court July 3 in the Northern District of California, the suit claims that the ordinance is preempted by current law.
"This lawsuit is part of the California Restaurant Association’s commitment to establishing a statewide standard for nutritional information disclosure that allows restaurants some flexibility in determining the best way to provide their customers with nutritional information," said Jot Condie, president of the California Restaurant Association. "A patchwork of local ordinances would be challenging and confusing for restaurants and their customers."
The California Restaurant Association is working with the governor and the state legislature to establish a flexible, statewide standard for making nutritional information available in restaurants. Recognizing that some customers wish to review nutritional information before making their selection, the California Restaurant Association is sponsoring AB 2572 (Parra), which is awaiting a hearing in the Appropriations Committee of the California State Senate.
