No reheating 'window' pies in New York

Slice pizza blog recently received a letter from a distraught New York pizzeria owner who said that a city Department of Health official told him he couldn’t reheat and serve the pizza in his display, as the cheese had already cooled below regulation temperatures.
 
Slice excerpted the letter:
'I am having a huge problem. I run a pizzeria, and we have gotten a warning from the Board of Health saying that pizza is not allowed to be used off of the slice display.
 
'This, of course, has to do with the fact that the cheese cannot be left between 40°F and 140°F and then reheated. No matter how hot the oven is, it is still a violation according to the Board of Health.
 
'My question is, how do i comply with their regulations and still produce a quality product?'
 
A forum followed in the Slice blog. The consensus was that the pizzeria owner might have been visited by a rogue, “overeager” health official. The implications for this by-the-slice-pizza oriented city are dire if the move is part of a larger crackdown.
