California delivery driver sues firm for overtime pay

Nation's Restaurant News: A former driver for Santa Ana, Calif.-based Delivery Drivers Inc. is suing the company, claiming he and other drivers were denied minimum wage and overtime pay.

DDI is an outsourcing company that supplies drivers to restaurant food delivery businesses.

The suit alleges that DDI wrongly classified driver Eli Levinson as a contracted employee to skirt California's labor laws. Drivers had to use their own cars and pay for their own insurance and gas, but had to wear DDI uniforms. DDI also dictated the hours drivers could work, where to place their signs on their automobiles, the content of the sales literature they carried and what to say to customers, according to the suit.
