Bloomberg News: Despite being dismissed twice by New York courts, a lawsuit filed by two teenagers claiming McDonald's food made them obese will again go before a judge.
The burger chain said it will again appeal the "frivolous" lawsuit on the basis of patrons' personal choice and responsibility. (Read also Judge dismisses obesity lawsuit against McDonald's.)
In 2003, U.S. District Judge Robert Sweet dismissed the suit, which seeks billions of dollars in damages, on the grounds that it lacked sufficient evidence to blame McDonald's for the plaintiffs' obesity.
On Jan. 25, an appellate court reversed Sweet's decision by ruling that plaintiffs Ashley Pelman and Jazlen Bradley and their lawyers should be allowed to collect more evidence to support their accusation that McDonald's is hiding harmful nutritional information from its patrons.
